FAQ: Personal Injury Cases
How do I know if I have a valid case?
For a case to have merit there must have been damages suffered through a negligent or wrongful act. These injuries come about in many different circumstances, including in car accidents, motorcycle accidents, and dog bite cases as well as accidents in the workplace. To determine whether you have a case requires a full evaluation your specific circumstances, the degree of injury, and the type of incident that took place. At Givens Givens Sparks we offer a free case evaluation to assist you and answer your questions about your case and potential legal action.
How long do personal injury cases take to resolve?
The resolutions of these cases vary. In cases of catastrophic injury, such as traumatic brain injury, spinal cord injury or others, as the settlement sought will be extremely high value, it can take longer than those in which the injured victim will recover within a predicted length of time. We always press for a fast resolution, but the recovery of compensation sought must be sufficient and reflect the damages that our client has suffered. If we need to go to court we will do so for our client.
Isn't a personal injury lawyer expensive?
Personal injury cases are taken on a contingency basis; if we don't win, you don't pay. In addition, we advance all of the costs necessary to pay for a medical expert evaluation and to fully investigate and gather evidence to support your claim. This allows you to have high quality legal representation without an initial outlay of funds. When the case settles, we take a reasonable percentage of the settlement. We are happy to further discuss our terms with you at our initial consultation.
What if I have been offered a settlement?
When a victim of negligence is offered a settlement without legal counsel to review the case it is likely you are being offered an amount far lower than you could have gotten with support from our firm. It is advised that you do not sign paperwork or answer questions from insurance adjusters or provide medical records until you speak with us.
What types of personal injury cases does your firm take on?
We represent clients who face all types of injuries in many types of cases, including but not limited to car accidents,
truck accidents, and other motor vehicle accidents. Should you or a family member have been a victim of a
dog bite, we can help you pursue litigation. Significant injuries caused by
medical malpractice including
birth injury and catastrophic injury cases are common cases that we handle with acuity and attention to detail. In cases of loss of life through negligence or wrongful acts, a
wrongful death claim would be the legal action taken. Whatever the case, we can seek to provide the legal representation you need to get the compensation deserved.
